Terms of Service

These terms govern your use of Open House Kit. By creating an account or using the service, you agree to them. Please read them carefully.
The service
Open House Kit, operated by RDNZ Media LLC, is software for real estate agents that turns the details of a single listing into a set of open house marketing assets: a property description, flyer, social posts and captions, QR code, visitor sign-in page, follow-up email, and neighborhood highlights, and stores the leads captured through visitor sign-ins for the agent who owns the listing.
Accounts and eligibility
You must be at least 18 years old and able to form a binding contract to use the service. When you create an account, you agree to provide accurate information, keep your sign-in credentials secure, and accept responsibility for activity that occurs under your account. Notify us promptly at support@openhousekit.app if you suspect unauthorized use of your account.
Subscriptions and billing
Some features of the service require a paid subscription. Paid plans are billed month-to-month, and you can cancel at any time; cancellation takes effect at the end of the current billing period, after which your account moves to the free plan. Current pricing and plan features are described on our pricing page, and we may change them prospectively with reasonable notice.
Your content and generated assets
You retain ownership of everything you provide to the service: your listing details, photos, brand assets, and other content. You grant us a limited license to host, process, and display that content solely to operate and provide the service.
You own the marketing assets the service generates from your inputs. You may use, edit, print, post, and distribute them for your business without restriction. The underlying software, template designs, and generation system remain ours.
You are responsible for ensuring you have the rights to the content you upload, including listing photos and brokerage marks, and that you are authorized to market the listings you enter.
Acceptable use
When using the service, you agree to:
- Provide accurate listing information. Generated assets reflect what you enter, and you are responsible for reviewing them for accuracy before publishing.
- Comply with all laws and rules that apply to your real estate marketing, including fair housing laws and the rules of your MLS, board, and brokerage. Compliance of your marketing with these obligations is your responsibility.
- Comply with CAN-SPAM and other applicable email laws for any follow-up emails you send to leads, including honoring opt-outs and identifying yourself accurately.
- Not misuse the service, including attempting to access other users’ data, disrupting the service, or using it for unlawful, deceptive, or harassing purposes.
Our intellectual property
The service itself, including the software, design, template systems, and branding, is owned by us and protected by intellectual property laws. Except for the rights to your content and generated assets described above, these terms do not grant you any rights in the service.
Disclaimers
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Generated content is a starting point: we do not warrant that it is accurate, complete, or compliant with the marketing rules that apply to you, and you should review every asset before publishing it.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to the service. To the same extent, our aggregate liability for all claims relating to the service will not exceed the amounts you paid us for the service in the twelve months before the claim arose.
Termination
You may stop using the service or close your account at any time. We may suspend or terminate your access if you materially violate these terms, if required by law, or if we discontinue the service, and we will give you reasonable notice where practicable. Upon termination, the licenses you granted us end, except as needed to comply with law or wind down your account.
Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify account holders by email or through the product before the changes take effect. Continuing to use the service after changes take effect means you accept the updated terms.
Governing law
These terms are governed by the laws of the State of Nevada, USA, without regard to its conflict-of-laws rules.
